The Eastman Kodak company has won the first battle in its patent war against iPhone maker Apple and BlackBerry manufacturer Research In Motion.
 
Kodak sued both companies to get royalty payments that relate to its patents, which regards the use of cameras in mobile phones. Following this legal action Apple filed a countersuit against Kodak, claiming that Kodak illegitimately employed its digital camera technologies within numerous camera- and video camera ranges.
 
According to Reuters, a judge of the International Trade Commission (ITC) yesterday ruled in favour of Kodak, finding that the camera maker had not infringed upon Apple’s patented technology for digital cameras. The judges' ruling will now either be upheld or rejected by the full ITC panel on 19 September.
 
The next step in the process will be for the ITC to rule on the complaint filed by Kodak against Apple and RIM, which is expected to take place on 23 May. 
 
Kodak also successfully took on LG in 2009 and Samsung in 2010 over the same patents obtaining $414 million and $550 million respectively from each manufacturer.
