Gaming pirates and PS3 jailbreakers beware

The crackdown on video game piracy in South Africa kicks into high gear, with the first local PlayStation 3 jailbreak raid taking place yesterday at a residential property in Parktown, Johannesburg. Jailbreak devices are used to circumvent the security features on PS3 game consoles, in order to facilitate the playing of pirated PS3 gaming titles.

This raid was conducted by the South African Police Service’s Commercial Crime Unit, after receiving criminal complaints from the South African Federation Against Copyright Theft (SAFACT). Members of the police were assisted by the South African Revenue Service (SARS) Computer Forensics Lab.

Various state of the art computers, circumvention software packages, jailbreak USB devices, PS3 consoles as well as hard-drives were seized during the raid. In addition documentation, fake PS2 games and original PS3 games, believed to be employed as master copies, were also seized.
 
One suspect has been arrested and will remain in custody until the court appearance for bail in the Specialized Commercial Crimes Court either today or early tomorrow. According to Jacques Botha, director of Finance and Special Operations for SAFACT, it is the first PS3 circumvention arrest in the world, with similar raids to be conducted across South Africa soon.
 
Update: The suspect who is of Pakistani origin, received bail this afternoon. Bail was set at R10 000, with the passport also having to be handed in. Next court appearance is set for 29 September.

Circumventing is not illegal in SA (yet) - we don't have a DMCA equivalent law. Possession of copied disks is also not illegal *if* you have the originals as well (Copyright law allows backups).

Basically, unless they've got someone to testify that he was selling those disks, the prosecution is s**t out of luck. My guess is that an undercover cop purchased the disks in a sting, and thats what they're going to nail him on.

It's great how Sony can just remove features from MY Playstation, but heaven forbid I crack the darn thing. Apparently I don't own my own things anymore. I just lease them from the companies that sell them to me.

And we think Julius Malema has no respect for property?

Thoes airplanes for CEOs aren't going to buy them themselves people!

Freenetproject.org is a nice place where one can discuss such stuff without fear - uncensorable crypto network - like TOR but more secure (also a bit slower) if you are interested read about it, spend 5 minutes to install it, also get Sone to access boards to talk.

Really? This is how we're spending our resources? I'm not condoning piracy, but just considering the numbers, how can we justify cracking down on it?!

What is a fake game? There have been lots of reports of fake software recently. You are a supposed tech site, please get it right. Were the games in question written by the original authors? If so, they are not fake. They are (legal or illegal) copies of the original. If I make a copy of a picture or painting, it is a copy. If I recreate that picture or painting myself, it is a fake.

This is the same country where, "It is estimated that a woman born in South Africa has a greater chance of being raped than learning how to read." and in 2004 we had the highest murder rate in the world (it's still extremely high 37 per 100 000).

So it's awesome that we've got our priorities right!
