Even though both Apple and Samsung recently agreed to hold settlement talks with their respective CEOs and chief legal counsels in tow, the two firms are still filing lawsuits against each other. The most recent court action is a counter lawsuit filed by Samsung against Apple last week, with the Northern District federal court of California.

According to the FOSS Patents blog, this lawsuit involves eight patents which the Cupertino-based iPhone maker is allegedly violating. These includes ones for multimedia synchronisation; a system for remote video transmission; as well as an apparatus for recording and reproducing digital image and speech.

Two of these patents are FRAND-pledged, with Samsung having declared them as essential to ETSI (European Telecommunications Standards Institute) standards. This is an interesting move, considering that the European Commission recently opened a formal investigation into the Korean tech giant to determine if Samsung Electronics had abused certain of its standard essential patent rights to distort competition.

Samsung filed its latest lawsuit in response to Apple suing the company during February via the same court, over an alleged violation of eight of its patents. Apple sought a court order blocking the sale of the 17 of Samsung’s products including the Galaxy Nexus and all US variants of the Galaxy SII.

In other patent related news, Twitter recently asserted that it will not be party to any offensive patent lawsuits, promising to commit to utilising its patents purely for “defensive purposes”. The company revealed details behind its draft Innovator’s Patent Agreement, via which the social networking site promises to keep control of its patents in the hands of engineers and designers.
